Parents of Multiples Win Important Case in the Federal Court of Appeal Permitting Human Rights Complaint to Proceed
In a recent and important decision following a long and winding procedural history concerning the fight of parents of twins, triplets, and other multiples for improved employment insurance parental leave benefits, the Federal Court of Appeal has held that Tania Zulkoskey, the mother of twins, should not have had a discrimination complaint she filed summarily dismissed by the Canadian Human Rights Commission. Ms Zulkoskey alleged at the Commission that the provision of EI benefits, in failing to recognize the birth of two or more children, is discriminatory. The Commission refused to hear the complaint because a previous father of twins had lost discrimination arguments in his own case.
Ms Zulkoskey can now attempt to proceed with her complaint at the Commission.
