What Are My Rights?
The Ontario Human Rights Code prohibits discrimination in the context of employment on the following protected grounds:
- Age;
- Ancestry, colour, race;
- Citizenship;
- Ethnic origin;
- Place of origin;
- Creed;
- Disability;
- Family status;
- Marital status;
- Gender identity, gender expression;
- Record of offences;
- Sex (including pregnancy and breastfeeding); and,
- Sexual orientation.
If you have been discriminated against, you may be able to file a claim before the Human Rights Tribunal, or in court. There are pros and cons to filing a claim in either forum. You should contact one of our lawyers for advice about which forum is best for your case.
While we often think of workplace discrimination in the context of existing employees, discrimination complaints can also arise before employment starts. For example, if a would-be employer asks a discriminatory question in the interview process, or if you feel you were not hired for a discriminatory reason (because of a pregnancy, for example), you have recourse through the Human Rights Code and can file a claim for human rights damages.
