What Are My Rights?
If you have been sexually harassed by a co-worker, manager, or even a client, you have rights under the Ontario Human Rights Code and the Ontario Occupational Health and Safety Act. Federal employees have similar rights under the Canadian Human Rights Act and the Canada Labour Code.
Some examples of sexual harassment in the workplace include:
- asking for sex in exchange for advancement or a benefit in the workplace;
- repeatedly asking for dates, and not taking "no" for an answer;
- demanding hugs;
- making unnecessary physical contact, including unwanted touching;
- making sex-related comments about a co-worker;
- sharing sexual images or cartoons;
- making sexual jokes; and,
- bragging about sexual prowess.
Both men and women can be the victims of sexual harassment in the workplace, though women tend to experience sexual harassment more often than men do. Employees who have been sexually harassed may be entitled to monetary damages and to other remedies to ensure that sexual harassment in the workplace stops.
