What Are Ministry of Labour Complaints?
If your employer has violated any of your rights under the Ontario Employment Standards Act (the “ESA”), you can file a complaint with the Ontario Ministry of Labour (the “MOL”). However, it is important to know that the MOL enforces only the minimum standards of the ESA or the terms set out in your employment contract (whichever is greater).
Common complaints before the MOL include claims for unpaid wages, unpaid vacation or public holiday pay, and “misclassification” cases (meaning your employer has inappropriately treated you as an independent contractor when you are in fact an employee).
While the MOL enforces your minimum ESA rights or the terms set out in your employment contract (whichever is greater), you might be entitled to more generous “common law” rights. For example, if your employment has been terminated, you might be entitled to something called a “common law notice period”, which is usually much more beneficial than the minimum notice period set out in the ESA (click here to learn more about wrongful dismissal).
